    Pass Purchase Terms and Conditions

    OUR AGREEMENT WITH YOU

    When you purchase a Pass on our website, the following conditions apply to your purchase (which also constitute our agreement with you):

    • The Pass purchase conditions (below).
    • The refund and exchange conditions (below).
    • The Pass usage conditions.
    • The privacy and cookie policy.
    • Any additional conditions presented to you before your purchase.

    It is important that you accept all conditions before your purchase. If you do not accept any of our conditions, you should not purchase a Pass on our website. If you have any questions regarding our conditions, please contact our customer service.

    1 - DEFINITIONS

    The following terms have the meaning given to them by this Clause, both in singular and plural form:

    1.1 - Detailed Definitions

    Railee, we, our, us: refers to TRAINXEUROPE SAS. You, your: any person who purchases or proposes to purchase a Pass under the Offer. Account: your personal account on the Website. Agreement: the agreement concluded between you and us by which you accepted our Offer for the purchase of one or more Passes.

    2 - APPLICATION

    These Pass Purchase Terms apply to and govern the Offer and purchase of a Pass on our Website and the Agreement.

    2.1 - Scope of Application

    These Pass Purchase Terms apply to and govern the Offer and purchase of a Pass on our Website and the Agreement.

    2.2 - Review of Terms

    You can review these Pass Purchase Terms on our Website before accepting the Offer. You must read these Pass Purchase Terms carefully to see if the Pass is the right product for you. If you do not accept all our terms, you must not purchase a Pass.

    2.3 - Inconsistency of Terms

    Unless stated otherwise, in case of inconsistency between the terms set out in these Pass Purchase Terms and any information on our Website, the term or information that is most favorable to you will apply.

    3 - ABOUT RAILEE

    Important information about our role and status.

    3.1 - Railee as Intermediary

    We act as an intermediary for the sale of Passes on behalf of Interrail.

    3.2 - Railee is Not a Railway Company

    We are not a railway company and do not provide or operate any passenger transport services ourselves. We also have no control over or influence on the operations of any of the Participating Companies. However, we work closely with the Participating Companies to enable Pass Holders to use their Pass on passenger transport services operated by the Participating Companies.

    4 - OFFER AND ACCEPTANCE

    To purchase a Pass on our Website, you will need to pay the purchase price of the Pass.

    4.1 - Required amount to purchase a Pass

    All prices, fees and costs communicated by the Website include (local) taxes and are communicated to you before the conclusion of the Agreement. If any other costs are fixed and unavoidable, they will be included in the purchase price of the Pass. Payment can be made in any of the currencies available on our Website. The purchase of the Pass does not include Seat Reservations, which must be made separately.

    4.2 - Promotional Passes

    From time to time, as part of commercial promotions, we offer Passes at reduced prices. These commercial promotions may also include conditions that are in addition to the conditions set out in the Pass Purchase Terms.

    4.3 - Delivery fees

    Delivery of a mobile Pass is free.

    4.4 - Firm offer

    The Offer is legally binding on us, except in cases where there is a manifest error or fault in the Offer. We may modify or withdraw the Offer at any time before you accept it.

    4.5 - Offer acceptance

    Acceptance of the Offer can only be made on the Website by paying the purchase price of the Pass. Your acceptance will be effective when you have made the payment and we have received it.

    5 - ELIGIBILITY CONDITIONS FOR PURCHASING A PASS

    You can purchase a Pass on the Website if your country of residence is among the available options and if you are able to use one of the available payment methods.

    5.1 - Additional requirements and restrictions

    You expressly acknowledge that there are additional eligibility conditions and restrictions on the use of a Pass, including requirements based on age and country of residence.

    5.2 - Purchases for others

    You can purchase one or more Passes on behalf of one or more other natural persons.

    6 - THE PASS HOLDER

    The Pass holder must be designated before purchase and cannot be modified after.

    6.1 - Designation of the Pass Holder

    Before accepting the Offer, you must designate a natural person as Pass Holder for each Pass you intend to purchase. To do this, you must fill in the traveler's information before accepting the Offer. The traveler's information includes their title, first name, last name, date of birth and country of residence.

    6.2 - Acceptance of conditions by the Pass Holder

    When you designate another natural person as Pass Holder, you declare that the Pass Holder in question has read and accepts the conditions.

    6.3 - Non-transferability of a Pass

    A Pass cannot be transferred from one Pass Holder to another natural person.

    6.4 - Errors in traveler information

    For Mobile Passes, if you make a minor or obvious error when entering traveler information, you must ask Customer Service to correct this error.

    6.5 - Change country of residence

    For Mobile Passes, if the Pass Holder's country of residence changes after the Pass is issued, you must ask Customer Service to update the country of residence.

    6.6 - Proofs in support of rectification

    If you request a rectification or modification, we may ask you to provide supporting evidence to verify that the rectification or modification does not result in the transfer of the Pass.

    7 - PASS DELIVERY

    We deliver your Pass as follows.

    7.1 - Mobile Pass

    We will send you an order confirmation email to the email address associated with your account. You will need to follow the instructions to retrieve and activate the Pass via the Rail Planner app.

    8 - ACTIVATION DATE

    The activation of your Pass must be done under the following conditions.

    8.1 - How to activate your Pass

    To learn how to activate a Mobile Pass, please refer to your order confirmation email and/or the Pass Usage Terms.

    9 - PASS USAGE

    The use of the Pass is subject to the following conditions.

    9.1 - Compliance with Pass Usage Terms

    All Pass Holders must use their Pass in strict compliance with the Pass Usage Terms. You and all persons you designate as Pass Holders expressly acknowledge that the mere possession of a Pass does not constitute a contract of carriage.

    9.2 - Travel Documents

    It is your responsibility to ensure that you have the necessary travel documents and visas for travel within the Pass network. This responsibility also applies to any person you designate as a Pass Holder.

    10 - CHILD AND COMPANION PASS

    Special conditions apply to child and companion Passes.

    10.1 - Child Pass (for children aged 0-11)

    The Child Pass is intended for children aged 4-11. You can order up to two (2) Child Passes free of charge per Adult Pass. Child Passes are issued in the same form as the corresponding Adult Pass.

    10.2 - Free Companion Pass

    If the Pass Holder uses their Pass as a Person with Reduced Mobility, a free Pass can be requested for a natural person who will accompany the Person with Reduced Mobility. The person designated as the Free Pass Holder must be at least 17 years old.

    11 - REFUNDS AND EXCHANGES

    The refund and exchange conditions are defined below.

    11.1 - Mobile Pass Refund Conditions

    Your Mobile Pass (excluding promotional Pass) can be refunded and exchanged according to the following conditions: your Mobile Pass is not activated and you must submit your refund or exchange request no later than 3 business days before the last possible activation date. The Pass is 100% refundable within 30 days of purchase, then 80% refundable up to 3 business days before the last possible activation date. Unused travel days are neither refundable nor exchangeable unless the above conditions are met. For promotional Passes, they are 100% refundable within 7 days of purchase, and non-refundable after this period.

    11.2 - Promotional Pass

    Refund and exchange conditions for promotional Passes vary. Check the promotional conditions to see if your Pass is refundable and/or exchangeable. The offer is not valid for Passes purchased outside the promotional period.

    11.3 - Right of Withdrawal

    The legal right of withdrawal does not apply to the purchase of a Pass.

    11.4 - Delays, Missed Connections, and Train Cancellations

    All refund requests related to delays, missed connections, and train cancellations are not handled by RAILEE. Please fill out the Interrail compensation form.

    12 - RAILEE LIABILITY

    Our liability is limited as defined below.

    12.1 - Disclaimer

    As we only act as an intermediary on behalf of the Participating Companies, we cannot be held liable, and we will not accept any liability, for any loss or damage arising from the operations of a Participating Company.

    12.2 - Liability Limitation

    If we are held liable for losses or damages arising from the Agreement or in connection with it, this liability will be limited to the amount paid for the relevant Pass under this Agreement.

    13 - MISCELLANEOUS CONDITIONS

    Miscellaneous conditions applicable to Pass purchase.

    13.1 - Applicable Law

    To the extent permitted by law: these Pass Purchase Terms and the Agreement are governed by and construed in accordance with French law; and the competent court is the French court of the department.

    13.2 - Severability Clause

    If any of the terms set out in these Pass Purchase Terms is found to be unenforceable, contrary to law, or invalid, the other terms will not be affected and will remain fully applicable.

    13.3 - Precedence of French Version

    In case of inconsistency between the French version of these Pass Purchase Terms and any other version in another language, the French version will prevail.

    13.4 - Modification of Pass Purchase Terms

    We may modify these Pass Purchase Terms at any time and without notice. When a term is modified, we will create a new version of the Pass Purchase Terms. The version applicable to the Agreement is the version published on the Website at the time the Agreement is concluded. Previous versions of these Pass Purchase Terms may be requested from our Customer Service.
